The Uncontested Divorce Process
If you and your spouse agree on the terms of your divorce, you can proceed with an uncontested divorce or separation agreement.
I will draft the divorce stipulation of settlement or separation agreement based on the terms that you and your spouse have agreed upon. I will help through negotiation to arrive at a settlement which is in your best interests. Then, your spouse will review, approve and sign the divorce stipulation of settlement or settlement agreement. Once the divorce submission papers are filed with the Court and entered with the county clerk, your divorce is finalized.
If, during the process, I discover that your spouse does not agree with any of the terms that you wish to have in the stipulation of settlement or separation agreement, I will zealously fight for your rights. I have extensive experience with contested divorces as well as uncontested divorces, and I will work hard to ensure that you are not taken advantage of by your spouse and that your rights are fully protected.
Separation Agreements
If you enter into a Separation Agreement, you must wait one year before seeking to convert it into a divorce. I will draft your Separation Agreement and advise you of your rights during the negotiation period through the execution of the Separation Agreement.
Separation Agreements can be used in a number of circumstances. Often, clients enter into a Separation Agreement when they hope to reconcile their marriage but want to protect their rights in the even that they are not able to do so.
